1.1 General Terms and Conditions of Sale

The cottage is intended for rental purposes and is not suitable for festive gatherings. The lessor undertakes to welcome tenants on the scheduled day of their arrival, to facilitate their settling in, their stay, and their exploration of the region. The relationship between lessor and tenant is based on trust. The tenant agrees to respect the rented property and return it in good condition. Under no circumstances can the tenant claim any right to remain on the premises after the expiration of the initial rental period specified in this contract, unless agreed upon by the lessor. No modification, erasure, or addition is accepted in the drafting of the contract without the agreement of both parties.

Payments : The reservation becomes effective when the tenant pays a deposit amounting to 30% of the rental amount for the stay, before the agreed date at the time of contact with the owner. The balance is due no later than 10 days before arrival. If the tenant delays their arrival, they must notify the lessor in advance and send the remaining rent payment by the originally scheduled rental start date. Payment can be made by bank transfer or in cash.

Security Deposit : To cover any loss or damage that may occur to installations, objects, furniture, or others, a security deposit of €900 is paid by the tenant in addition to the rent, equal to one week of rental (via a separate, uncashed check). This deposit is due no later than the day of arrival. If no damage is found after the check-out inspection, the deposit is promptly refunded to the tenant. In case of damages found, it will be refunded within a maximum of 2 months after the departure date, after deducting the amount for repairs or replacement of lost items. The amount is determined by mutual agreement between lessor and tenant. In case of dispute, a quote will be provided by a professional or an authorized organization, requested by the tenant before departure or, if not, by the lessor during the check-out inspection. This deposit cannot be considered as part payment of the rent. Your insurance, linked to your vacation insurance certificate, may also be used if necessary.

Arrival : The rental starts, unless agreed otherwise, at 3:00 PM. The tenant must arrive on the specified day and at the times mentioned in the contract. In case of late or deferred arrival, the tenant must inform the lessor. The lessor is present to welcome you, show you around the cottage, and inform you about all practical details. The lessor and the tenant conduct an inventory check. The lessor personally hands over the keys to the cottage or places them in the designated key boxes.

Departure : The rental ends at 10:00 AM or at a time agreed upon with the lessor after the check-out inventory. Before the check-out inventory, the tenant must return the premises to the condition in which they found them despite the cleaning fee: items must be tidied, furniture put back in place, floors swept, refrigerator and dishwasher emptied and cleaned, trash emptied, sorted, and placed in outdoor containers. The tenant returns the keys.

Use of Premises : The tenant enjoys the rental in a peaceful manner and makes good use of it, in accordance with the intended use of the premises. Upon departure, the tenant agrees to return the rental in as clean a condition as it was upon arrival. All equipment is returned to its original location. The tenant undertakes to maintain in perfect condition the sanitary, electrical, and heating facilities. Any repairs necessitated by negligence or improper use during the rental period will be borne by the tenant, both within the premises and throughout the property. The rental may not in any case benefit third parties, unless agreed upon in advance by the lessor. Subletting by the designated tenant is prohibited, under any circumstances, even gratuitously, under penalty of contract termination. The full rental amount remains payable to the lessor.

Number of Persons : The number of people using the rental may not exceed a maximum capacity of 5 people.

Inventory and Condition Report: An inventory and condition report of furniture and various equipment are conducted at the beginning and end of the stay by the lessor and the tenant. If the lessor identifies damages, they must inform the tenant within two weeks, and the security deposit will be handled as specified in the "Security Deposit" chapter. If the tenant identifies damages, they must inform the lessor within 24 hours.

Cancellation Policy :

Due to the client :

Any cancellation by the tenant must be notified by phone call, SMS, or email to the lessor.

The cancellation fees applied are as follows:

  • More than 6 months before the start of the stay: full refund of the deposit

  • Between 3 to 6 months before the start of the stay: 50% refund of the deposit

  • Less than 3 months before the start of the stay: no refund will be made

If the tenant does not show up by 9:00 PM on the scheduled day of the stay, this contract becomes null and void, and the lessor may dispose of their accommodation.

In case of early departure, the price corresponding to the cost of accommodation for the full duration specified in this contract remains fully payable to the owner.

Due to the lessor :

Any cancellation by the lessor before the start of the stay is notified to the tenant by phone call, SMS, or letter. The tenant, without prejudice to any recourse for compensation for any damage suffered, is immediately reimbursed for the sums paid.

Cancellation due to force majeure or a pandemic :

In the event of a government decision preventing the client from making the stay or the lessor from providing the service as agreed in the contract, the lessor undertakes to postpone the stay at no cost to a later date (subject to availability at the time of choosing new stay dates).

Insurance : The tenant is responsible for any damage they may cause to the rented property, movable or immovable. To cover this risk, the tenant is required to insure the premises rented to them. Therefore, they must check whether their main housing contract includes the "holiday" or "vacation rental" extension. If not, they must contact their insurer to request an extension of the coverage or take out a specific contract under the "holiday" clause. An attestation must be provided by the tenant to the lessor 10 days before the start of the stay.

Disputes or Complaints : To the extent possible, complaints will be resolved amicably. However, in the absence of an amicable agreement between the tenant and the lessor, any dispute may be submitted to the competent courts.

Protection of Personal Data :

The tenant is informed that the personal data provided during the establishment of the contract may be processed. In accordance with Regulation (EU) No. 2016/679, known as the General Data Protection Regulation (GDPR), each tenant has the right to access, rectify, object to, delete, transfer, and limit the processing of information concerning them. These rights can be exercised by contacting the lessor.

1.2 Internal Regulations

In order to ensure maximum safety for everyone, make your stay enjoyable, and maintain the facilities in good condition, tenants are required to comply with the internal regulations and undertake to respect safety and hygiene instructions in the interest of all. The following points must be observed and respected:

Article 1 : Your Arrival

Upon your arrival, you will be given the keys and the inventory. The general terms, internal regulations, and the list of cottage equipment will have been annexed to the reservation contract.

An inventory will be conducted at the beginning and end of the stay.

Article 2: Provided Equipment

This accommodation is rented with bedding (bed bases and mattresses), duvets, and pillows as listed in the inventory. You must keep the protective covers for mattresses and pillows, which must remain clean upon departure.

A starter kit (trash bag, sponge, coffee pod, laundry detergent, dishwasher tablets, cleaning products, salt, pepper, vinegar, oil...) is provided in minimal quantities upon arrival. You must bring your own supplies.

Reminder!!! Before your departure the bed sets should be folded and deposited at the foot of each bed

Article 3 : Use of Premises

All furniture is at your disposal. Please keep it in good condition and ensure it remains clean.

The supply of water, electricity, and heating is included in the rental price within reasonable limits (meter readings for water and electricity are taken upon each arrival and departure). However, to best respect the environment, please turn off lights when leaving a room, do not unnecessarily let water run, and do not leave doors and windows open for long periods if heating is in use.

All amenities are at your disposal, subject to normal and reasonable use.

It is strictly forbidden to dispose of anything in the toilet other than toilet paper (septic tank).

Each access door to the accommodation is equipped with a key lock. You are responsible for any theft or damage resulting from non-compliance with this clause.

Reminder!!! In the event of a blockage (blocked toilet) due to malice, the tenant's liability is engaged.

Article 4 : Charter for the use of internet box and its services

This charter aims to define the rules for using the internet box located at 411 La Garoterie 44310 Saint Philbert de Grand Lieu.

Access to the internet box services is reserved for persons with a rental contract and only during the period of this contract.

The Wifi network of the accommodation allows persons with a Wifi-enabled mobile device to connect to the internet for free using the codes provided on the day of arrival. These codes may not be transferred to any third party under any circumstances.

The internet network allows browsing the internet and sending electronic messages via various software.

Internet, networks, and digital communication services are not law-free zones; this charter therefore specifies the responsibilities of users, in accordance with applicable law, to enable normal use of the box and internet network.

Tenants agree not to use internet services for illegal or prohibited purposes.

Article 5 : Use of the pellet stove

Pellet stove : usable according to the season (pellets provided based on reservation).

It is strictly forbidden to put wood, plastic, or paper into the stove. Please refer to the user manual.

You are responsible for any damage to the stove due to improper use.

Reminder!!! In the event of malfunction due to malicious intent, the tenant will be held responsible.

Article 6 : Waste Sorting

Bins as well as a "Sorting Guide" booklet are at your disposal: please respect the sorting rules:

Biowaste in the designated bucket => to be emptied into the compost area at the back of the garden;

Cardboard, plastic, and metal packaging => to be emptied into the yellow container near the driveway;

Household waste => to be emptied into the blue container near the driveway;

Glass => to be deposited in the black bin near the driveway.

We place great importance on waste sorting for environmental respect.

Please dispose of your glass items in the designated container at Moulin de La Chaussée (opposite Biocoop).

Failure to comply with sorting and failure to dispose of glass will result in an additional charge of €30.

Reminder!!! Upon departure, please empty the bins.

Article 7 : Safety and Courtesy Guidelines

Please respect the tranquility of the premises and use them in accordance with their intended purpose. The volume of noise, both inside and outside the property, must be kept low to respect the neighborhood's tranquility. In case of conflict or complaint, we reserve the right to exclude the guests causing the disturbance.

Out of respect for the neighborhood, it is strictly forbidden to make noise after 10 PM and before 7 AM.

Smoking inside the accommodation is strictly prohibited.

In case of emergency, please contact emergency services (18 for fire department, 15 for SAMU, 17 for police, 112 for mobile phones).

Throughout the stay, children are under the responsibility of their parents. Since the forest and road are nearby, do not let children wander alone without being accompanied by their parents or a responsible adult.

Tenants must ensure that windows and skylights are closed in case of rain (especially during storms).

Tenants are required to contract a "Villegiature" Civil Liability Insurance policy with their insurance company covering all premises entrusted to them for damages such as fire, explosion, water damage caused by themselves or their guests during the rental period. An insurance certificate in the tenant's name must be attached to the booking contract.

Reminder!!! The owner cannot be held responsible for any accidents or damages that may occur on the property, parking, or maneuvering in and out of the cottage. Thank you for your understanding.

Article 8 : Cleaning Fee

Reminder!!! The accommodation must be returned as clean as you found it upon arrival...

Sanitary facilities: toilets, shower, and sinks "traps";

Appliances (fridge, dishwasher, washing machine, coffee maker, microwave...);

Furniture (chairs, sofas, tables...);

Dishes (cutlery, plates, glasses, dishes...) must be cleaned and put away;

Floors must be vacuumed and cleaned of significant stains.

THE SAME APPLIES TO EXTERNAL EQUIPMENT (terrace, tables, barbecue, ...)

End-of-stay instructions are posted in the cleaning area.

Article 9 : Pet Policy (not allowed)

Pets are not allowed on the property. However, we can direct you to a kennel located 10 minutes from the cottage.

Article 9 : Parking

Vehicles may park in the gravel outdoor parking area. Space is available for parking 3 vehicles.

Article 10 : Barbecue

Only the use of charcoal is allowed in the barbecue; it must be emptied of its ashes. A bucket is provided for this purpose.

Article 11 : Maintenance

Depending on the length of the stay, we may need to intervene during your stay for mowing, watering flowers, and maintenance. We will respect your privacy.

Article 12 : Cottage Capacity

The cottage's capacity is 5. A tolerance may be granted under financial conditions. Failure to comply with this clause will result in an additional charge.

Article 14 : Problem Resolution

In case of breakdown or malfunction, please contact us immediately. We will do our best to remedy the situation. No reimbursement for troubleshooting or repairs will be considered without our agreement.

In case of breakage, disaster, or damage, please report it during your stay, even if no damage seems apparent. In case of loss or damage to items in the accommodation, the security deposit may be reduced by the cost of restoration or replacement.
